Bad Blood in the Civil Court: Revenge Dressed as a Peace Order

The afternoon sun beat down on the pavement outside the Harare Civil Court, but the heat inside Courtroom 7 was of a different variety. It was thick with the scent of old paper, floor wax, and the palpable friction between two women who sat on opposite ends of the wooden benches.


Annamore Mucheki stood before Magistrate Janemary Makonye, her voice trembling—less with fear, it seemed, and more with a simmering, long-held resentment.

“Your Worship,” Annamore began, smoothing her dress. “I am a mother seeking peace. This woman, Fungai, has turned my life into a circus of insults. She calls me names I cannot repeat in this honorable court. She tells me I am dirty, that I do not know how to bathe, and that is why our husband left me.”

She paused, casting a side-eye toward Fungai, who remained stony-faced. “It is not just about me. She calls my children rats. When I try to call the father of my children to discuss their welfare, she is the one who answers. She cuts the line. She blocks the gate to their father’s heart.”

The most stinging blow, Annamore claimed, was a visit to the children’s school. She described a scene of confusion where Fungai allegedly interrogated the little ones about their mother’s new boyfriend, leaving them "fearful and bewildered."

When it was Fungai Mutimatema’s turn to speak, the narrative shifted from a story of harassment to one of self-defense.

“I have blocked her, Your Worship,” Fungai said firmly. “I do not know where she lives, and I do not wish to know. I only went to that school because my husband asked me to accompany him. Once she complained, I stopped.”

Then came the pivot—a claim that turned the room cold. Fungai alleged that the harassment wasn't flowing toward Annamore, but from her.
“Her brother in South Africa sends me videos,” Fungai told the court, her voice dropping. “He brandishes a firearm. He tells me he does not fear killing. He says he will find me. If anyone is in danger here, it is me. She only resurfaced after two years of separation because she saw me being introduced to the in-laws. This is not about a peace order; it is about her wanting a life she walked away from.”


Magistrate Makonye looked from one woman to the other. She didn't see two victims; she saw two combatants using the legal system as a secondary battlefield.

"This court should not be used to settle scores,” Makonye’s voice rang out, sharp and authoritative. “Applications must be brought with clean hands".

Magistrate noted that the air in the room was thick with "bad blood." She pointed out that while the law exists to protect the vulnerable, it was being invoked here to satisfy a desire for retaliation. The mention of firearms and cross-border threats, she warned, moved the matter from a civil spat into the realm of criminal offense.

The Magistrate was not impressed by the theatrics. She saw the "revenge" lurking behind the legal jargon. However, to prevent the simmering tension from boiling over into physical violence, she made a pragmatic decision.

 A peace order was granted to both parties.

Both women were ordered to cease all forms of communication and interference.

 "Separation should be handled amicably," Makonye concluded. "Violence or intimidation is not a solution."

As they filed out of the courtroom, Annamore and Fungai headed in opposite directions. The peace order was a piece of paper, but in the crowded streets of Harare, the real test would be whether their "clean hands" could finally let go of the grudge.
