Step-by-Step Guide to Appealing Criminal Convictions and Sentences in Zimbabwe

Important Information for Unrepresented Litigants

  1. Appealing against both conviction and sentence:
    A person convicted by a Magistrates' Court who wishes to appeal to the High Court against both the conviction and the sentence must file a Notice of Appeal within 10 days from the date of conviction.

  2. Appealing against sentence only:
    A person wishing to appeal against the sentence only must file the Notice of Appeal within five (5) days from the date the sentence is imposed.

  3. Lodging the Notice of Appeal:
    Prepare four copies of the Notice of Appeal and submit them to the Clerk of the Court for stamping. Alternatively, the Notice may be lodged electronically through an E-Filing Centre, where assistance is available.

  4. Service on the National Prosecuting Authority (NPA):
    After the Notice has been stamped by the Clerk of the Court, serve it on the National Prosecuting Authority (NPA). Ensure that the NPA acknowledges receipt by stamping the Notice.

  5. Uploading documents through IECMS:
    Create an Integrated Electronic Case Management System (IECMS) account and upload scanned copies of the stamped Notice of Appeal to the Registrar of the High Court.

  6. Confirmation of the appeal:
    The Registrar will verify compliance with the applicable court rules. Once the requirements have been met, the Notice of Appeal will be stamped, the appeal confirmed, and a High Court case number allocated.

  7. Submission to the Clerk of the Court:
    Download the Registrar-stamped Notice of Appeal from the IECMS and submit a copy to the Clerk of the Court for further processing and case management.

Note: Compliance with the prescribed time limits and procedural requirements is essential. Failure to file an appeal within the stipulated period may result in the loss of the right to appeal unless the court grants leave for late filing.
